Award decisions, debriefs, and avoiding bid protests. Specific topics will include:

  • How to effectively use the debriefing process to defuse disagreements and avoid protests
  • Myths and realities of the protest process (and how often the government really wins)
  • How your business may be impacted and ways to protect your company and your customer’s interests
  • Valid and weak grounds of protest plus practical alternatives
  • Pre-award actions to consider to avoid being protested
  • Understand the strict time requirements of the protest process – and the common forums where they are adjudicated
  • What it means to “win” a protest

The seminar will be taught by Ken Brody, a founding partner of the law firm of David, Brody and Dondershine, LLP in Reston, Virginia. Ken has over forty years of experience dealing with procurement issues, as a trial attorney with the Department of the Navy, and for the past 30 years in private practice. His practice focuses on representing government contractors, particularly small businesses, on all aspects of government contracting, including negotiating agreements, regulatory requirements, the small business programs, bid protests and litigating contract disputes. He also teaches classes for Virginia PTAC on Teaming and Subcontracting and on the Government-wide Mentor-Protégé Program.
