    COVID-19 Protocol Compliance Guidance For Federal Contractors

    Are you up to speed on the new COVID Safety Protocols for Federal Contractors, and related compliance concerns? If you haven't been following these critical legal developments (or even if you have) it's time to tune in and pay attention! Covered contractors will need to comply with a slew of new safety protocols - including sweeping employee vaccination mandates (and monitoring/documenting employee vaccination status), masking/physical distancing requirements (and related weekly monitoring and signage-creation) and the designation of a COVID Coordinator. They will also need to flow down COVID protocol clauses to their subs. If you do business with the Federal government, it is vital that you understand your new obligations or risk major non-compliance issues. In this webinar, experienced government contracting attorney Maria Panichelli will walk you through what you need to know: Where these new protocols came from; what exactly you (and your subs) need to do; when you need to do it; and the important things you need to think about in the immediate and long term. Maria will discuss how to deal with and respond to modifications to existing contracts, as well as new solicitations including the COVID deviation clause. Indirect cost rates are necessary for contract pricing and payment purposes on government contracts. An indirect cost rate is simply a way of determining how to fairly and conveniently proportion indirect costs to a contract or activity of an organization.     Limitations on Subcontracting & The SBA’s Government-Wide Mentor Protégé Program

    In 2016, the SBA implemented the SBA’s small business mentor-protégé program. This program may potentially be one of the most important and far-reaching federal contracting programs for small businesses in recent memory. The new rule establishes for the first time a Government-Wide mentor-protégé program for all small businesses, which is consistent with the program for participants in SBA’s 8(a) program. The course will cover the provisions of the rule, including: program eligibility requirements, negotiating mentor-protégé agreements, the benefits of these agreements, joint venturing between mentors and protégés for small business set-aside opportunities, and compliance with SBA’s requirements. The Program will also explore SBA’s recent significant changes to the rules that limit subcontracting under set-aside contracts.

    The seminar will be taught by Ken Brody, a founding partner of the law firm of David, Brody and Dondershine, LLP in Reston, Virginia. Ken has over forty years of experience dealing with procurement issues, as a trial attorney with the Department of the Navy, and for the past 30 years in private practice. His practice focuses on representing government contractors, particularly small businesses, on all aspects of government contracting, including negotiating agreements, regulatory requirements, the small business programs, bid protests and litigating contract disputes. He also teaches classes for Virginia PTAC on Teaming and Subcontracting and on the Government-wide Mentor-Protégé Program.
