Sole Source Awards

Obtaining “sole source” or “direct” contract awards should be an important part of a small government contractor’s growth plan. Generally, the government must compete contract awards among special status small businesses (i.e., SDVOSBs, WOSBs, and HUBZones) whenever the contracting officer expects that two or more qualified small businesses in that special status category will be able to submit an offer for the contract opportunity (the “Rule of Two”). However, certain special status small businesses (particularly 8(a)s) may be eligible for sole source awards in certain circumstances. Furthermore, the government can always make a sole source award to any company when justified due to a need a unique need, for example, the government’s need for a brand name re-sale, unusual or compelling urgency, or in the interest of national security. This session will cover the legal requirements for sole source awards and how to best position your company for a sole source award.
