DESCRIPTION:A bid protest is a challenge to the terms of a solicitation or the award of a contract by a federal government agency. A contractor who chooses to contest the award of a federal government contract can file a bid protest in any of three different forums: (1) at the procuring agency\, (2) at the Government Accountability Office (GAO)\, or (3) at the U.S. Court of Federal Claims (COFC). This class will provide an overview of the bid protest process and discuss the costs and benefits associated with each of the three different forums. It will also outline strategies that contractors can use to navigate the bid protest process and position themselves for success.

DESCRIPTION:THE SBA’S GOVERNMENT-WIDE MENTOR-PROTEGE PROGRAM AND NEW LIMITATION ON SUBCONTRACTING RULE: THE NEW RULES AND HOW THEY WILL CHANGE SMALL BUSINESS SET-ASIDE CONTRACTING \nIn 2016\, the SBA implemented the SBA’s small business mentor-protégé program. This program may potentially be one of the most important and far-reaching federal contracting programs for small businesses in recent memory. The new rule establishes for the first time a Government-Wide mentor-protégé program for all small businesses\, which is consistent with the program for participants in SBA’s 8(a) program. The course will cover the provisions of the rule\, including: program eligibility requirements\, negotiating mentor-protégé agreements\, the benefits of these agreements\, joint venturing between mentors and protégés for small business set-aside opportunities\, and compliance with SBA’s requirements. The Program will also explore SBA’s recent significant changes to the rules that limit subcontracting under set-aside contracts. \nSpecific topics will include: \n\nEstablishing eligibility of Protégés and Mentors\nNegotiating the intricacies’ of a written Mentor-Protégé Agreement that complies with SBA requirements\nBenefits of Establishing a Mentor-Protégé agreement for both parties\, including the ability to create joint ventures that can compete as small businesses under set-aside procurements\nHow limitations on subcontracting are calculated under the new SBA rule\nExplain how “similarly situated” subcontractors can be used in light of the new limitation on subcontracting rule\nConsequences for not complying with SBA requirement\n\nThe seminar will be taught by Ken Brody\, a founding partner of the law firm of David\, Brody and Dondershine\, LLP in Reston\, Virginia. Ken has over forty years of experience dealing with procurement issues\, as a trial attorney with the Department of the Navy\, and for the past 30 years in private practice. DESCRIPTION:Obtaining “sole source” or “direct” contract awards should be an important part of a small government contractor’s growth plan. Generally\, the government must compete contract awards among special status small businesses (i.e.\, SDVOSBs\, WOSBs\, and HUBZones) whenever the contracting officer expects that two or more qualified small businesses in that special status category will be able to submit an offer for the contract opportunity (the “Rule of Two”). However\, certain special status small businesses (particularly 8(a)s) may be eligible for sole source awards in certain circumstances. Furthermore\, the government can always make a sole source award to any company when justified due to a need a unique need\, for example\, the government’s need for a brand name re-sale\, unusual or compelling urgency\, or in the interest of national security. This session will cover the legal requirements for sole source awards and how to best position your company for a sole source award.

SUMMARY:The CMMC 2.0 Paradigm and Contractor Supply Chain Risk Management Obligations
DESCRIPTION:Since January 2018\, the Defense Department (and now other agencies) has required prime contractors and subcontractors at all tiers to implement NIST SP 800-171\, “Protecting Controlled Unclassified Information in Nonfederal Systems and Organizations.” Between January 2018 and November 2021\, the Defense Department issued numerous guidance memoranda regarding NIST-171 and set up an arrangement with the Cybersecurity Maturity Model Certification – Accreditation Board. In turn\, the CMMC-AB developed a “CMMC ecosystem” based on NIST-171 and related NIST guidance in order to identify NIST-171 cybersecurity objectives intended for contractors and subcontractors who handle\, create or store “controlled unclassified information” or CUI. A significant element of this ecosystem was the creation of an infrastructure which facilitates education\, training and third-party assessment leading to the certification of a DIB company’s implementation of CMMC 1.0 compliance. \nThe Defense Department paused implementation of the CMMC 1.0 program by introducing CMMC 2.0 through an Advanced Notice of Proposed Rulemaking published November 4\, 2021. DESCRIPTION:THE SBA’S GOVERNMENT-WIDE MENTOR-PROTEGE PROGRAM AND NEW LIMITATION ON SUBCONTRACTING RULE: THE NEW RULES AND HOW THEY WILL CHANGE SMALL BUSINESS SET-ASIDE CONTRACTING \nIn 2016\, the SBA implemented the SBA’s small business mentor-protégé program. This program may potentially be one of the most important and far-reaching federal contracting programs for small businesses in recent memory. The new rule establishes for the first time a Government-Wide mentor-protégé program for all small businesses\, which is consistent with the program for participants in SBA’s 8(a) program. The course will cover the provisions of the rule\, including: program eligibility requirements\, negotiating mentor-protégé agreements\, the benefits of these agreements\, joint venturing between mentors and protégés for small business set-aside opportunities\, and compliance with SBA’s requirements.
